Internet Service Agreement & Terms of Service
These terms explain how NLRS Broadband service works, customer responsibilities, equipment return requirements, payment terms, limitations, and acceptable use of service.
Agreement Overview
This Internet Service Agreement (“Agreement”) is entered into between North Louisiana Radio Service (NLRS) and the subscribing Customer (“Customer”) as of the date service is activated. By activating service, making payment, or using NLRS equipment, Customer agrees to the following terms and conditions.
1. Service Description
NLRS provides wireless broadband internet service utilizing third-party carrier networks and tower infrastructure. Service speeds and performance may vary based on tower congestion, signal strength, customer location, weather conditions, network maintenance, physical obstructions, and carrier-side network management.
NLRS does not guarantee specific speeds at all times. Advertised speeds represent maximum attainable speeds under ideal conditions.
2. Equipment Ownership
All routers, antennas, SIM cards, and related equipment provided by NLRS remain the sole property of North Louisiana Radio Service unless otherwise stated in writing.
Customer is granted use of the equipment only for the duration of active service. Equipment may not be modified, disassembled, transferred, sold, discarded, or tampered with.
3. Return of Equipment
Upon cancellation, termination, or non-payment, Customer must return all NLRS-owned equipment within 10 calendar days. Equipment must be returned in good working condition, normal wear and tear excepted.
If equipment is not returned, is damaged beyond normal wear, intentionally destroyed, discarded, lost, or stolen, Customer agrees to pay the replacement cost of the router or associated equipment, not to exceed $300 per router unless otherwise specified.
Failure to return equipment may result in billing for replacement cost, automatic draft of the replacement amount if authorization is on file, and collection action where permitted by law.
4. Payment Terms
Service is billed monthly in advance. Payments not received within 5 days of the due date will incur a $5 late fee.
Continued non-payment may result in suspension or termination of service and immediate requirement to return equipment. NLRS reserves the right to modify pricing with notice.
5. Service Limitations & Disclaimers
NLRS does not control third-party carrier network performance and does not intentionally throttle, restrict, or limit internet speeds. NLRS does not monitor, inspect, record, or store Customer internet browsing content.
Internet service may be subject to carrier-level network management policies outside NLRS control. Service interruptions may occur due to carrier outages, maintenance, weather events, power outages, equipment failure, or acts of God.
NLRS is not responsible for indirect damages, business losses, or downtime-related losses.
6. Acceptable Use
Customer agrees not to use the service for illegal activity, spamming, network abuse, resale without authorization, or activities that violate federal, state, or local law.
NLRS reserves the right to suspend service if illegal or abusive activity is detected or reported by upstream providers.
7. No Guarantee of Continuous Service
While NLRS strives for reliable service, continuous uninterrupted service is not guaranteed. Wireless internet service may experience variability compared to wired infrastructure.
8. Cancellation by Customer
Customer may cancel service prior to the next billing cycle. No refunds will be issued for partial months once billing has occurred unless otherwise agreed in writing.
Equipment must be returned as outlined in Section 3.
9. NLRS Right to Terminate Service
North Louisiana Radio Service (NLRS) reserves the right to suspend or terminate service at any time, with or without notice, for any reason deemed necessary to protect its business interests, network integrity, compliance obligations, or operational requirements.
In the event of termination by NLRS, Customer remains responsible for returning all equipment as outlined in Section 3 of this Agreement.
10. Limitation of Liability
NLRS liability shall be limited to the amount paid by Customer for the most recent month of service. NLRS shall not be liable for loss of data, business interruption, loss of profits, or indirect, incidental, or consequential damages.
11. Indemnification
Customer agrees to indemnify and hold harmless North Louisiana Radio Service from any claims arising from misuse of service or violation of this Agreement.
12. ACH / Auto-Draft Authorization for Equipment
If Customer provides ACH or debit/credit authorization for recurring billing, Customer authorizes NLRS to draft the replacement cost of equipment, up to $300 per router, in the event equipment is lost, damaged, destroyed, discarded, or not returned as required under this Agreement.
NLRS agrees to provide written notice prior to any such draft.
13. Agreement Acceptance
By activating service, making payment, or using NLRS equipment, Customer acknowledges that they have read and agree to these Terms of Service.
